Kagan’s New Recusal Count Is 21 Cases

The Supreme Court’s newest justice, Elena Kagan, has indicated she will recuse herself in more than half of the cases the Supreme Court has already agreed to hear this term.

Kagan “quietly recused herself” in 10 more cases this week, bringing her total recusals to 21, according to The BLT: The Blog of Legal Times.

During her confirmation hearings, Kagan indicated that she would decline to participate in 11 cases because she was counsel of record as solicitor general. “The new batch appears to reflect a determination that her participation at earlier stages—even where her office did not file a brief—required her to step aside,” the BLT says.
