In Griswold v. Connecticut (1965) and later in Roe v. Wade (1973), access to contraceptives and abortions were determined to be guaranteed by a right to privacy. The justices were divided in Griswold over which provisions of the Constitution provided such a right, with some finding it in the “penumbras”—the Ninth Amendment and/or the 14th Amendment.
