A Texas judge who is facing a drunken-driving charge can stay on the bench, but can’t hear DUI cases or other criminal cases involving the officers who arrested him, an administrative law judge says.

Ruling on a request by Bexar County District Attorney Susan Reed that District Judge Raymond Angelini be recused from hearing all criminal cases pending the outcome of his DUI case, Administrative Judge David Peeples decided Monday to impose a more limited restriction on Angelini’s docket, reports the Associated Press.

Reed had previously asked Angelini, who has been on the bench 14 years, to recuse himself from all criminal cases, according to WOAI, a local NBC News affililate.

Angelini was arrested last week, after San Antonio police saw his car weaving in traffic. He reportedly had to use his car door to remain upright before failing a field sobriety test. He refused to take a breath test, although he admitted to having “maybe three drinks,” the AP article says.
