Tax Lawyer Held at Gunpoint Gets Chance at Trial
An Indiana tax attorney who police held at gunpoint after a pizza shop employee falsely accused him of pulling a gun will have a shot at winning damages at a false imprisonment and defamation trial.
The Indiana Court of Appeals has ruled that Tennessee lawyer Sanford Kelsey, formerly of the Indianapolis area, can move ahead to trial against the Papa John’s pizza chain, the National Law Journal reports.
The Indianapolis Star describes a “harrowing” 2005 police stop in which Kelsey and a friend were accused of pulling a gun and holding up the deliveryman. The charges ultimately turned out to be false, and the accuser pleaded guilty to false crime reporting among other charges
The July 11 decision overturns a lower court ruling that prematurely tossed the case without giving the plaintiffs a chance to amend their complaint.
