The U.S. Supreme Court on Thursday denied an emergency request to block bans on assault weapons adopted by Illinois and one of its cities.
It was the second refusal by the Supreme Court, which also turned down an emergency request in May. In the interim, the 7th U.S. Circuit Court of Appeals at Chicago ruled that the bans were likely constitutional.
Two laws are being challenged. An ordinance passed in August 2022 by the Chicago suburb of Naperville, Illinois, bans the commercial sale of assault rifles. The second, passed in January by the state of Illinois, is called the Protect Illinois Communities Act. It bans the sale and purchase of assault weapons and high-capacity magazines.
Those challenging the law had sought to temporarily block enforcement to give them time to file a cert petition, SCOTUSblog reports.
