Suit: Ladies’ Nights Unconstitutional

A New York City attorney claims nightclubs that charge women less money are violating his constitutional rights.

Roy Den Hollander has filed suit seeking a declaratory judgment that the policies are “state action” because the nightclubs are overseen by liquor regulators, the National Law Journal reports. He says a ruling would entitle him to sue for the equal protection violation under Section 1983 of the Civil Rights Act.

“Whether this case succeeds or fails,” says Hollander, “it will result in a much needed victory for men.”

The general manager of the China Club, one of the bars named in the suit, says Hollander’s claim is “ridiculous.”
