Suit claims Peet's Coffee misrepresents French press serving size

A would-be class action lawsuit filed last Friday alleges Peet’s Coffee & Tea is misrepresenting its French press serving size.

The suit was filed in Cook County, Illinois, on behalf of customer Robert Garrett, report the Chicago Tribune, Nation’s Restaurant News and the Am Law Litigation Daily.

According to the suit, Peet’s post signs for French press coffee in 12- and 32-ounce serving sizes, but the actual amount of the beverage is at least 25 percent less than that.

Peet’s chief marketing officer Tyler Ricks told the Tribune the signs refer to the size of the press pot. “We are committed to honesty and integrity, and we uphold the highest standards,” he said.

Chicago lawyer Dan Voelker is representing Garrett. In a press release, Voelker says the suit is “very similar to the suit filed against Subway” in which the plaintiffs alleged that the restaurant’s foot-long sandwiches were less than 12 inches long.

A preliminary settlement in the Subway case provides for injunctive relief and gives the nine name plaintiffs up to $1,000 each.
