SCOTUS refuses another stay in a same-sex marriage case
The U.S. Supreme Court on Thursday refused to grant a stay that would have blocked same-sex marriages in South Carolina.
The order (PDF) said Justices Antonin Scalia and Clarence Thomas would have granted the stay, report the National Law Journal (sub. req.), the New York Times and SCOTUSblog. Those justices would have also granted stays in previous gay-marriage cases.
South Carolina had argued the stay should be granted as a result of a recent ruling by the Cincinnati-based 6th U.S. Circuit Court of Appeals that created a circuit split on whether gay marriage bans are unconstitutional.
