Director Roman Polanski has failed in his latest attempt to block his extradition to the United States from Switzerland.

A California appeals court on Thursday denied a request to end the 33-year-old case by sentencing the acclaimed director, who is under house arrest in Switzerland, to time served, the New York Times Arts Beat blog and Associated Press report.

The court’s ruling may pave the way for Switzerland to act next. Authorities there have said they won’t act on Polanski’s extradition until California courts make clear that he is expected to appear in the U.S. to face sentencing.

Polanski, who avoided rape and sodomy charges concerning a 13-year-old girl by pleading guilty to unlawful sex with a minor, fled the country in 1978 before he was sentenced.
