Plaintiff: Movie Theater Armrest Struck Me As I Answered My Cell Phone
A plaintiff in an Illinois lawsuit is seeking damages for a head injury she says she suffered when a movie theater armrest struck her as she was “discreetly” leaning down to answer her cell phone during a screening of The Incredible Hulk.
Taj Showers says she suffered a concussion and blurred vision after the June 14, 2008 incident at the Kerasotes Niles Showplace 12 as a result of the theater’s negligent failure to inspect and maintain its seating, reports the Chicago Tribune.
Her suit, which was filed yesterday in Cook County Circuit Court, alleges damages in excess of $50,000.
A spokeswoman for the movie theater declined to comment.
Chicago Bar Tender provides a copy of the complaint. It was filed by attorney Gregory Leiter, who practices in Joliet, Ill.
