David Schubert, a former Las Vegas prosecutor who handled the Paris Hilton cocaine case, was charged Thursday with felony gun and drug possession, as well as conspiracy, the Las Vegas Review-Journal reports.

Defense lawyer William Terry says Schubert will plead not guilty to the charges, filed by the Nevada attorney general’s office, the Associated Press reports.

A Las Vegas police officer stopped Schubert’s vehicle in March, after observing what he thought was a drug deal. The officer noticed what turned out to be 0.01 grams of cocaine in the car, according to the article, and also found a handgun and ammunition.

The handgun was legally registered, according to the Review-Journal, but Schubert is being prosecuted for gun possession under a state law that prohibits people addicted to or using drugs from possessing firearms. The criminal complaint indicated that Schubert tested positive for drugs at the time of his arrest.

According to Schubert’s arrest report, a convicted drug dealer who jumped out of the vehicle when police approached stated that for the past six months, Schubert had been buying crack cocaine two or three times a week.

A month after the arrest Schubert resigned from the Clark County district attorney’s office. He’d worked there 10 years, according to the Review-Journal, and prosecuted most of the office’s top drug cases. In Hilton’s case, a pretrial plea deal was entered in September 2010.
