NYC Council Has Answer for Proof-of-Service Questions: GPS Confirmation

The New York City Council passed a bill Thursday intended to make sure that defendants actually receive notice of pending lawsuits.

The bill requires process servers to record the date, time and location of service with a Global Positioning System, the New York Times reports. Licensing and bonding are also required.

The bill addresses questions about service procedures raised in a 2008 study by a nonprofit law firm, the Times says. It found that only 10 percent of consumer debtors in boroughs outside Manhattan show up for court hearings.

Two lawsuits go further, alleging wrongdoing. One April suit by Attorney General Andrew Cuomo alleges a Long Island process server company filed false affidavits. Another suit, filed in December, alleges wrongdoing by process servers and debt-collection companies.
