A judge has ruled that an Ohio prosecutor fired for walking around naked after hours in a government building where he worked is entitled to civil service protections.

The former prosecutor, Scott Blauvelt, was fired after security cameras videotaped his nude nighttime strolls on two occasions, the Oxford Press reports. Blauvelt’s lawyer, Mike Gmoser, blames the behavior partly on medication used to treat depression and seizures and partly on a brain injury suffered in a car accident, the Cincinnati Enquirer reports. Blauvelt had worked for the city of Hamilton.

The decision by visiting Judge Thomas Nurre gives Blauvelt the right to a civil service hearing on whether there were sufficient grounds to fire him, Local12.com reports. The website has a photo from the video with a well-placed bar.

Gmoser says his client has overcome the problems that fueled the behavior and he’s working as a criminal defense lawyer.
