Actress Lindsay Lohan spent less than a day in jail after a judge sent her there for testing positive for drugs while on probation in two drunken driving cases.

On Friday morning Judge Elden Fox of Beverly Hills had sent Lohan to jail without bail until a hearing Oct. 22, but her lawyer quickly appealed, according to the Associated Press and the Los Angeles Times blog L.A. Now. Later that day, Judge Patricia Schnegg, the assistant supervising judge of the criminal courts in Los Angeles, ruled that Lohan was entitled to bail since she was convicted for misdemeanors.

The L.A. Now blog asked lawyers whether Lohan was getting special treatment. Defense lawyer Mike Cavalluzzi agreed with the decision to allow bail. “She neither presents a danger to the community nor is she a flight risk,” he told the blog.

Meanwhile, TMZ.com reports that Lindsay Lohan’s father, Michael Lohan, left a voice mail for his daughter’s lawyer, Shawn Chapman Holley, that advised her to quit the case and threatened to “blow you out of the water.”

“It’s true. I said those things,” Michael Lohan told the blog, “but it’s spun.” He said he was angry because he had told the lawyers all along that his daughter needed to go to rehab and “just now they’re listening.” TMZ has a photo of Lindsay Lohan wearing her new alcohol monitoring bracelet, and says in a separate post that she plans to go back to rehab.
