Legal malpractice claims are up in 2011, according to a survey of the insurance brokerages that provide three-quarters of the coverage to large and midsize law firms in this country.

They blame the difficult economy and struggling real estate market for the increase, reports the Am Law Daily. Claims are up as much as 20 percent at one brokerage, although others say they are experiencing rises of 10 percent or less compared to 2010.

Real estate practitioners are most likely to be targeted for claims, which are most often focused on alleged conflicts of interest and late filing issues.
