Lawyers’ Conduct ‘Reeks,’ Judge Says
A federal judge in San Francisco is criticizing a plaintiffs law firm, saying its conduct in a lawsuit against a vacuum cleaner company “reeks.”
Wall Street Journal’s Law Blog (sub. req.) is highlighting the feisty decision yesterday by Judge Marilyn Hall Patel denying class action status in the suit against Oreck Direct.
Patel said the plaintiff came forward after responding to a newspaper ad and did not read the complaint before it was filed by the law firm, Westrup Klick. “It is clear from the record that plaintiffs counsel, and not plaintiff, is the driving force behind this action,” she said.
