Judge's Daughter, Convicted in Fatal DUI, Sues Driver She Hit
The 21-year-old daughter of a juvenile court judge in Houston has filed suit against a truck driver she rear-ended in a fatal DUI accident last year.
Elizabeth Shelton’s suit—which also names 15 other defendants, including insurers and banks—seeks compensation for injuries and property damage resulting from the Oct. 23, 2007 accident, in which Shelton’s boyfriend, Matthew McNiece, was killed, reports the Houston Chronicle.
Shelton, whose blood-alcohol level was more than three times the legal limit, was convicted of intoxication manslaughter and sentenced to four months in jail and eight years of probation. However, she apparently may intend to argue in the lawsuit that Lance Bennett, who was at the wheel of the truck she rear-ended, caused the accident by swerving into her lane, according to the newspaper.
Says Bennett’s attorney, John Havins: “They’re just throwing everything against the wall to see if anything sticks.”
