High Court to Hear Retaliation Claim of Worker Who Cooperated in Internal Probe

The U.S. Supreme Court has agreed to decide whether a worker who is fired after cooperating in her employer’s internal probe of sexual harassment may sue for retaliation.

Nashville, Tenn., school employee Vicky Crawford, who was fired after more than 30 years on the job, contends in her cert petition (PDF posted by SCOTUSblog) that she is protected by Title VII of the Civil Rights Act, the Associated Press reports. Crawford claims she was fired for telling company investigators that a school official under investigation had also harassed her.

The Cincinnati-based 6th U.S. Circuit of Appeals had ruled (PDF posted by SCOTUSblog) that Crawford was not protected because she didn’t initiate the harassment claim.

The case is Crawford v. Metro Nashville Government.
