Epstein Becker Partner Sues Greenberg's Leslie Corwin, Claims Malpractice
Partnership law expert Leslie Corwin of Greenberg Traurig is defending a malpractice suit by pointing a finger at the plaintiff, a partner with Epstein Becker & Green.
The plaintiff, Allen Roberts, claims Corwin and Greenberg Traurig mishandled an arbitration with Roberts’ former law firm, employment boutique Roberts & Finger, the New York Law Journal reports. He is seeking more than $6.6 million in damages.
But Corwin, an expert in partnership law, counters that Roberts caused his own problems when he acted as co-counsel in the dispute with Roberts & Finger and failed to accept Corwin’s advice.
After Roberts left Roberts & Finger, it voted to dissolve and sold its assets to a new firm led by two Roberts & Finger lawyers. Roberts claimed he was cheated out of his 37.8 percent equity interest in the sale, the story says. During the arbitration, an accountant was barred from testimony as an expert; Roberts blames Corwin for the problems. Roberts lost the case, was ordered to pay attorney fees and settled for $300,000, according to the complaint.
“Roberts’ damages, if any, must be reduced in whole or in part because of the comparative fault or negligence of Roberts himself,” Corwin and Greenberg Traurig said in court papers. Greenberg Traurig also said Roberts still owes more than $140,000 in attorney fees.
