Regardless of what happens at his ongoing trial for allegedly violating attorney ethics rules, the Durham, N.C., district attorney who prosecuted the rape case against three former Duke University lacrosse team members says he is going to resign from office.

“It is my intention,” testified a teary-eyed Mike Nifong today, “whatever decision is coming, to resign as district attorney in Durham,” reports Bloomberg. “It is not fair to the people of my community to be represented by someone who is not held in high esteem by either the members of the community or the members of the profession.”

Nifong, 56, is under fire for having prosecuted the players in spite of evidence that appeared to exonerate them of having raped a stripper at a team party, as she claimed. They were declared to be innocent by the North Carolina attorney general in an April news conference.
