Day Casebeer Lawyers Blame Qualcomm for Discovery Violations
Lawyers from the now-merged law firm Day Casebeer Madrid and Batchelder are pointing the finger of blame at Qualcomm for discovery violations in patent litigation that led to sanctions.
A brief filed Monday on behalf of one of the lawyers, Lee Patch, said the lawyers tried to be truthful with the court, but they were misled by Qualcomm personnel, the Recorder reports. “Mr. Patch asked the right people the right questions at the right time and got wrong—no, false—answers,” the brief said.
The briefs were submitted after a federal judge in California lifted sanctions against the lawyers and ruled they could testify under a self-defense exception to the attorney-client privilege. A January hearing will be held to determine whether the lawyers should be sanctioned, according to the story.
A brief filed on behalf of three other Day Casebeer lawyers, partners James Batchelder and Christian Mammen and associate Kevin Leung, said Qualcomm paralegals failed to search an important archive for documents. The brief also claims Qualcomm engineer Viji Raveendran lied about attending a meeting of a standards setting group that would impair the company’s patent claim.
Day Casebeer merged with the Howrey law firm in July.
