California Supreme Court to Rule on Gay Marriage Today
The California Supreme Court will issue a ruling today in a series of lawsuits that seek to overturn a law banning gay marriage.
The Massachusetts Supreme Court is the only top state court that has found a right to same-sex marriages, the Associated Press reports.
When the California Supreme Court heard oral arguments in the case in March, observers were left guessing whether the court would find a constitutional right to marry. Only one of the court’s seven justices indicated the ban should be overturned, while three others appeared inclined to uphold the ban. Three justices appeared critical of both sides.
The California court could take several approaches, the AP story says. It could strike down the ban and allow gay marriage. It could strike down the ban but allow lawmakers to fashion a remedy. Or it could simply uphold the ban.
Voters approved the 2000 ban in a measure that defines marriage as a union between a man and a woman.
