In Unusual Public Probe, Calif. Bar IDs 16 Lawyers in Loan Modification Case
In an unusual naming-of-names prior to any official determination of misconduct, the State Bar of California has publicly identified in a Sept. 18 press release 16 lawyers who are under investigation for alleged misconduct concerning loan modification services.
Interim Chief Trial Counsel Russell Weiner said the public identification of the lawyers being probed was necessary to protect the public:
“In my 21 years in attorney discipline, I have not seen a crisis of this magnitude. It is truly unprecedented,” says Weiner in the release. “The number of attorneys using their law licenses to essentially take money from unwary but trusting consumers is astounding.”
However, a representative for one of the lawyers named called the situation “substantially unfair” to the attorney and said only five of the 700 loan modifications completed by the law firm after much hard work has resulted in complaints, reports the National Law Journal.
