A former top official at the Department of Justice known for having blessed harsh interrogation techniques, including waterboarding, for terrorism suspects has told congressional investigators that the CIA used techniques on detainees that hadn’t been approved by the DOJ.

Jay Bybee told House Judiciary Committee investigators in May that CIA interrogators exceeded legal parameters on al-Qaida suspects, apparently by using unapproved techniques and waterboarding too many times, according to the Washington Post.

Bybee, who is presently a federal judge, is the former head of the DOJ’s Office of Legal Counsel.
