Assault-weapons case gets rehearing by full 4th Circuit
A full federal appeals court will reconsider a three-judge panel decision last month giving a boost to gun-rights advocates.
The Richmond, Virginia-based 4th U.S. Circuit Court of Appeals granted rehearing en banc on Friday, the Huffington Post reports. The 2-1 decision last month had ordered a Baltimore judge to apply strict scrutiny when evaluating Maryland’s ban on assault weapons and high-capacity magazines.
A dissenting judge had argued that the majority was “imprudently and unnecessarily breaking from our sister courts of appeals.”
The case is Kolbe v. Hogan.
