Appeals Court Voids Most of $2.5M Wilson Elser Malpractice Verdict
Saying that a $1.7 million damages award to a former law firm client for lost future profits was “speculative and uncertain,” a California appeals court has voided this portion of a malpractice verdict against Wilson Elser Moskowitz Edelman & Dicker.
But that still leaves the firm liable for another $941,000 to its former client, Cal-City Construction, over its bad legal advice over a building contract dispute that resulted in a settlement in that amount, reports the National Law Journal in an article reprinted by New York Lawyer (reg. req.).
“We are disappointed that any part of the verdict against our firm was affirmed,’ says Thomas Hyland, managing partner of the 800-lawyer firm’s New York office. “But we are pleased that the majority of claim has been knocked out.”
He says Wilson Elser hasn’t decided whether to pursue the case further.
