18 law firms join Crowell & Moring in calling for Trump’s removal; NYC bar also seeks ouster

Eighteen law firms have joined Crowell & Moring in calling on Vice President Mike Pence to use the 25th Amendment to remove President Donald Trump from office.

Crowell & Moring sent a letter to Pence saying the mob raid and occupation of the U.S. Capitol “was the direct and predictable result of a rally summoned by the president, at which he reinforced false claims of a rigged election.”

DLA Piper was among the 18 law firms whose leaders signed the letter along with Crowell & Moring.

The Crowell & Moring letter said Trump should be removed through Section 4 of the 25th Amendment, which applies when a president is “unable to discharge the powers and duties of his office.” Removal would have to be set in motion by Pence, who would have to declare that Trump is incapacitated along with a majority of Cabinet secretaries or a group appointed by Congress.

Also calling for Trump’s removal is the New York City Bar Association, which issued its own statement, according to a press release. The statement calls for removal either through the 25th Amendment or impeachment.

“President Trump has betrayed his oath to the American people,” the New York City Bar Association statement said. “Immediate steps must be taken to prevent any further seditious action by him and to ensure the integrity of our democracy and the security of the nation.”

The New York City Bar Association statement also said federal employees should take “appropriate steps to ascertain the legality of orders or directives which tell them to take action that they believe may be unlawful.”

Crowell & Moring’s 12-member management board signed its letter. Four of the nation’s 200 top grossing law firms joined Crowell & Moring through signatures by managing partners and other leaders, according to the American Lawyer.

Besides DLA Piper, the law firms are Foley Hoag, Sullivan & Worcester and Hanson Bridgett. Also signing was Farella Braun & Martel, through its managing partner. The firm is in Law360’s ranking of the nation’s top 400 law firms by head count.
