Individual decisions concerning the intimacies of physical relationships, even when not intended to produce offspring, are a form of liberty protected by due process. In overturning Bowers, Justice Anthony M. Kennedy (whom Stevens appointed to write the 2003 decision in Lawrence v. Texas, 539 U.S. 558), wrote, “Justice Stevens’ analysis, in our view, should have been controlling in Bowers and should control here.”
