Philly law firm sues Morgan & Morgan, claims its ads are misleading

Updated: A Philadelphia law firm has sued Morgan & Morgan for what it contends is misleading advertising by the Florida-based rival.

Rosenbaum & Associates filed the federal suit on Sept. 22 over Morgan & Morgan ads targeting personal injury clients in the Philadelphia area. The complaint says Morgan & Morgan leads consumers to believe the firm actively litigates cases in Pennsylvania even though it has just one Philadelphia lawyer with little personal injury experience, Law.com (sub. req.) reports.

The suit alleges the ads lead consumers to believe that the law firm and name partner, John Morgan, will be involved in their cases. In fact, the lawsuit alleges, Morgan & Morgan refers all or substantially all of the cases generated from Philadelphia advertising to other lawyers and firms.

The suit points to statements in the advertising by John Morgan such as, “I’m not just any lawyer, I’m your lawyer” and “We’re all here for you.” The ads also describe Morgan’s 30 years of experience and other personal information about him, wrongly implying that he and his law firm will be handling the suits, the complaint alleges.

Morgan is not licensed in Pennsylvania, the suit says. Other ads feature Matt Morgan, Dan Morgan and Mike Morgan, none of whom are licensed in Pennsylvania, the suit also says.

The ads are intended to undermine the competition, according to the complaint. The suit alleges false advertising and unfair competition.

John Morgan issued this statement about the lawsuit through a media representative: “It is utter nonsense. This guy doesn’t like competition. Sorry, it’s the American way. We look forward to delving into his financials and deposing his staff and clients.”
