Ex-McAfee GC Wants Law Firm Internal Probe Materials

Former McAfee general counsel Kent Roberts, facing criminal charges in a stock options backdating scheme, is seeking information from the law firm that conducted an internal investigation for the company.

Roberts’ lawyers are considering filing a motion to compel against Howrey in a separate civil case filed by the Securities and Exchange Commission, the Recorder reports. Lawyer William Freeman, who represents Roberts, told U.S. District Judge Marilyn Hall Patel of San Francisco on Monday that Howrey has relevant information it did not give to the government.

The legal publication mentions a prior case involving a similar discovery dispute. Former Brocade Communications CEO Gregory Reyes sought information from law firms conducting an internal investigation at the company. A federal judge ruled in the case that attorney-client privilege had been waived because the firms offered to share information with the government.

Reyes, who was convicted in a backdating scheme in August, is seeking a new trial, the Recorder reports in a separate story.
